O R D E R
This Writ Petition challenges the impugned refusal check slip issued in respect of the document presented by the petitioner.
2. Upon hearing the learned counsel for the petitioner and the learned Special Government Pleader, who takes notice for the respondents, it could be seen that the document has been refused registration for four reasons:
(i) The first reason is that the death certificate and the legal heir certificate have not been produced.
The learned counsel for the petitioner submits that they are in possession of the same and the same have also been annexed along with the typed set of papers and they are ready to produce the same. (ii) The second reason mentioned is that the original documents of title have not been produced.
The learned counsel for the petitioner submits that the original sale deed of purchase is available with them and they are ready to produce the same.

(iii) The third reason stated is that there is no patta. He submits that the Joint Patta originally issued is available and therefore the same may be taken into account. (iv) The fourth and final reason mentioned is that one of the executants of the document is stated to be not in a sound mental condition and therefore the document has been rejected. The learned counsel for the petitioner submits that the petitioner's father is mentally ill and the petitioner is taking care of him as his guardian and therefore he is representing him. When a specific and express recital has been made in the document regarding the same, it is for the purchaser to take note of it.

In view thereof, since the learned counsel for the petitioner submits that the petitioner is ready to rectify the discrepancies noted in the impugned refusal check slip, the following order is passed: i. The impugned refusal check slip is set aside and the matter is remitted back to the file of the second respondent. ii. The petitioner shall produce the original documents, Joint Patta, Death Certificate and Legal Heir Certificate, upon which Page No. 3 of 5
the document shall be registered by the second respondent, if it otherwise satisfies the requirements under law. iii. In any event, the proceedings shall be completed within a period of two weeks from the date of receipt of a web copy of this order.
