Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the second Respondent to grant permission for conducting "Panguni Thiruvizha" festival grant permission and necessary protection to perform the cultural programs including the dance program (Adal Padal) on 05.04.2022 at Sri Muthalaamman Thirukovil, Malliyampatti, Nilakkottai Taluk, Dindigul District.

ORDER

The Writ Petition has been filed in the nature of Writ of Mandamus, seeking a direction to the second respondent to grant permission for conducting "Panguni Thiruvizha" festival and necessary protection to perform the cultural programmes including dance program (Adal Padal) on 05.04.2022 at Sri Muthalaamman Thirukovil, Malliyampatti, Nilakkottai Taluk, Dindigul District. 2.When the matter is taken up for hearing, the learned Additional Public Prosecutor submitted that while the petitioner and the counter parties celebrated the panguni festival in front of Sri Muthalaamman Thirukovil, there was a clash between them. It led to register a FIR in Crime Nos.204 and 205 of 2019. Both the FIRs are pending for investigation.

W.P(MD).No.6111 of 2022 3.In view of the above submission, this Court is not inclined to direct the second respondent to grant permission. However, the second respondent is directed to issue notice to the petitioner and the counter party and after giving opportunity of hearing them, pass orders on or before 05.04.2022.

4.With the above direction, the Writ Petition is disposed of. No costs.
