For Respondent : Mr.R.M.Anbunithi, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.114/2023 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/accused No.2, who apprehends arrest at the hands of the respondent police for the offences punishable under sections 420, 465, 466, 468, 471 and 473 of I.P.C., in Crime No.114 of 2023 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution as per the de-facto complainant is that he is the Village Administrative Officer of Mettupatti Village and one P.M.Martin approached the defacto complainant for change of patta with legal heir certificate of Morisaral claiming that he is the only legal heir of the said Morisaral. CRL OP(MD). No.4896 of 2023 certificate is fake and thereafter, he enquired about the fake certificate and found that the petitioner, who is an agent, along with other accused created a fake certificate. Hence, the complaint.

3. Heard the learned counsel appearing on either side and perused the materials available on record, including the First Information Report.

4.Totally there are two accused, in which, the petitioner is arraigned as Accused No.2 and he is the Assistant of A.1. A.1 created a fabricated legal heir certificate and issued it to the parties, who were canvassed by the petitioner herein. The respondent so far seized so many company seals and fake documents from the first accused. Therefore, the custodial interrogation of the petitioner is very much required. Hence, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
