CRL OP(MD). No.5470 of 2020 Government Advocate(Criminal Side) for the respondent.

2. The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under sections 380 and 457 of IPC seeks anticipatory bail. Though the petitioner claim herself innocent, the accused arrested in one of these case for house breaking and theft had revealed the name of the petitioner as the holder of the stolen property. Confession statement of one Alagupandi who is the co-accused in all those cases indicates that he is an habitual offender of house breaking and theft. The jewels stolen by him has been given to the petitioner for melting and encashment. The petitioner has paid Alagupandi for the stolen property.

3. The learned Government Advocate(Criminal Side) would submit that substantial portion of the jewels is yet to be recovered. Unless and until the petitioner is apprehended it is difficult to recover the stolen property.

4. Considering the nature of crime and the reasonable objection of the learned Government Advocate(Criminal Side) this Court is not inclined to grant anticipatory bail to the petitioner.
