PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing to the 3rd Respondent to expeditiously submit the records pertains to survey Nos. 109/1, 109/2, 109/3, block - 21, wardD, Kodaikanal, based on the proceedings of the 2nd Respondent bearing O.Mu.No.1827/2025/A1 dated 16.09.2025 consequently directing the 2nd Respondent to cancel the forged Patta in favor of the Respondents 4 to 6 based on the petitioner's representation dated 10.09.2025 within the stipulated time frame fixed by this Court.

This Writ Petition has been filed to direct the 3rd Respondent to expeditiously submit the records pertains to survey Nos. 109/1, 109/2, 109/3, block - 21, ward-D, Kodaikanal, based on the proceedings of the 2nd Respondent bearing O.Mu.No.1827/2025/A1 dated 16.09.2025 consequently directing the 2nd Respondent to cancel the forged Patta in favor of the Respondents 4 to 6 based on the petitioner's representation dated 10.09.2025 within the stipulated time frame fixed by this Court.

2. The learned counsel for the petitioner submitted that the petitioner is entitled to the disputed property, while respondents 4 to 6 have also claimed rights over the same. In this regard, the petitioner submitted a representation to the second respondent/Revenue Divisional Officer. Upon receipt of the application, the second respondent initiated proceedings and, on 16.09.2025, called for a report from the third respondent. However, despite the request being made as early as September 2025, the third respondent has not submitted the report as on date. Therefore, the present writ petition has been filed.

3. Heard the learned Government Advocate appearing for the respondents 1 to 3.

4. Taking into account the above facts, the Court directs the 3rd respondent to submit a report to the 2nd respondent, within eight weeks from the date of receipt of a copy of this order. Thereafter, the 2nd respondent shall consider the petitioner's application within a further period of twelve weeks therefrom.
