Writ Petition filed under Article 226 of the Constitution of India, praying for a writ of Mandamus, to direct the second respondent to pass orders on the appeal petition, dated 28.04.2018 preferred by the petitioner challenging the proceedings of the third respondent in Na.Ka.No.2206/2018/Ou.Va-2, dated 23.04.2018. O R D E R

This writ petition has been filed praying for issuance of writ of mandamus directing the second respondent to pass orders on the appeal petition, dated 28.04.2018 preferred by the petitioner challenging the proceedings of the third respondent, in Na.Ka.No.2206/2018/Ou.Va-2, dated 23.04.2018. https://hcservices.ecourts.gov.in/hcservices/ 2.It is admitted that there is a dispute in respect of fixing the seniority between the directly recruited persons and the

promotees. Earlier writ petitions filed by the other direct recruitee before this Court questioning the inter-seniority list and the same is pending. Further, it is admitted that the petitioner has filed an appeal against the proceedings dated 23.04.2018 of 3rd respondent under Rule 37 of the Tamil Nadu Subordinate Service Rules, before the second respondent for considering his objections in respect of fixation of seniority.

3.The learned Additional Advocate General appearing for the respondents state that the second respondent may be given time to dispose of the appeal preferred by the petitioner in accordance with law.

4.It is left open to the petitioner to move any interim order in the said appeal before the second respondent while the second respondent heard the objections of the petitioner herein.

5. Considering the above facts, this Court is inclined to dispose of the writ petition and accordingly, dispose of the same directing the second respondent by granting three months time from the date of receipt of a copy of this order, to dispose of the objections raised by the petitioner before the second respondent. No costs. Consequently, connected miscellaneous petition is also closed.
