The Writ Petition has been filed in the nature of a Mandamus seeking a direction against the first respondent to issue passport to the petitioner consequent to application in File No.MD2064830271322, dated 02.12.2022.

2.Heard Mr.K.Sudalaiyandi, learned Counsel for the petitioner, Ms.Deepa, learned Counsel for the first respondent and Ms.D.Farjana Ghoushia, learned Special Government Pleader for the second respondent 3.The petitioner had filed the aforementioned application seeking passport. The first respondent had stated that they received an adverse report from the second respondent. It had been informed that an FIR in Cr.No.231 of 2020 had been registered against the petitioner and four others by the second respondent on 12.05.2022 for offence under Section 207 IPC and under Section 12 of Tamil Nadu Gaming Act, 1930. 4.The learned Special Government Pleader, who appears on behalf 2/4

of the second respondent stated that after investigation, final report had been filed before the learned Judicial Magistrate at Alangulam, but it had not yet been taken cognizance.

5.In view of this fact, a direction is issued to the first respondent that if the petitioner is otherwise eligible to proceed to issue passport. Necessary undertaking may be obtained from the petitioner. The entire exercise must be completed within a period of six weeks from the date of receipt of a copy of this order.
