ORDER : The Court made the following order :- The petitioner/A1 who apprehends arrest at the hands of the respondent police for the offences punishable under sections 8(c) r/w.20(b)(ii)(B)of NDPS Act in Crime No.206 of 2016 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with one accused were found in possession of 2 kilo and 100gms of ganja.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent and a false case has been foisted against him.

4. The learned Additional Public Prosecutor would submit that the petitioner along with one accused were illegally found in possession of 2 kilo 100gms of ganja, which falls under the category of commercial quantity.

5. Heard. Perused the materials available on record including the First Information Report.

6. It is seen that the total quantity of contraband recovered from the petitioner along with one accused is 2kg and 100gram of ganja and hence this Court is not inclined to grant anticipatory bail to the petitioner.

7. Hence this petition stands dismissed.
