Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus to call for the records pertaining to the impugned order passed by the second respondent in Na.ka.Na.5917/Ka5/2018 dated 11.03.2022 and quash the same and consequently direct the second respondent to sanction the medical reimbursement amount of Rs.8,90,328/- to the petitioner. Heard the learned counsel on either side.

2.The petitioner has now retired from service. When he was in service, he had heart ailment. He therefore went to Angel Heart Centre, Tirunelveli for taking treatment. Thereafter, he took treatment in the fifth respondent hospital and then in the sixth respondent hospital. Seeking reimbursement of the expenditure incurred by him, this writ petition has been filed.

3.The insurance company had made it clear that Angel Nursing Home is a network hospital and therefore, they are willing to honor the claim subject to the fulfillment of the other usual formalities ie., the petitioner has to produce the original bills and that the eligible amount shall be paid to the petitioner. The statement made by the fourth respondent is recorded. As far as the expenditure incurred in the fifth respondent hospital, the petitioner's claim will be considered by the second respondent as per the Tamil Nadu Medical Attendance Rules. The petitioner shall submit his claim to the second respondent in this regard and the second respondent shall process the same and pass appropriate orders on merits and in accordance with law within a period of eight weeks from the date of receipt of copy of this order. 3/5
