ORDER
Seeking direction to the second respondent to initiate appropriate action on the petitioner's complaint dated 23.01.2026 by conducting an enquiry as against the proposed accused, this criminal original petition is filed. 2.The learned counsel for the petitioner submitted that the petitioner is a senior citizen, whose mother, N.A.Khadhija Beevi, is the owner of the property comprised in Paramakudi Taluk, Survey Ward:G, Block No.21, Town Survey Nos.30, 31, 32, 33, 34, 35, 36. His maternal grandmother Tmt.A.K.F.Rahima Beevi, W/o.N.Abdul Majeed Rowther, executed a registered settlement deed bearing Doc.No.2392 of 1971 dated 01.12.1971 in respect to the said properties in favour of the petitioner's mother and thereby, she enjoys the absolute title and possession over the same.
Thereafter, the petitioner's mother had executed Hiba in favour of the petitioner on 12.06.2025 duly registered as Doc.No.P-63 in Joint No.I, Sub Registration Office, Madurai South. The petitioner's mother and the petitioner are continuously in possession with respect to all the properties till 12.06.2025. In the meanwhile, it is found that some of the person/ the proposed accused have created forged documents with respect to the aforeaid properties. In this regard, a complaint has been lodged.
3.The learned Additional Public Prosecutor submitted that a complaint was received and proper action will be taken. 4.Heard either side and carefully perused the materials available on record.
5.Considering the facts and circumstances of the case, the second respondent police is directed to put the petitioner as well as the rival parties on notice under Section 64 BNSS and give opportunity of hearing and take appropriate action in the manner known to law and dispose of the petition within a period of four weeks from the date of receipt of a copy of this order. 6.With the above directions, this Criminal Original Petition is disposed of.
