For Respondent : Mr.A.P.G.Ohm Chairma Prabhu, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C ORDER : The Court made the following order :- The petitioner seeks anticipatory bail in the case registered by the respondent police based on the complaint given by one Sudha for the offences punishable under sections 403,408 and 420 of IPC. 1/3

2. The learned Government Advocate (Crl.Side) would submit that the complaint has been received by the respondent police against these petitioners for cheating the defacto complainant's gold ornaments worth Rs. 45,00,000/-. These petitioners on receiving of summons has not appeared before the police for enquiry and their whereabouts are not known.

3. The learned counsel for the petitioner submit that there are ready to co-operate for enquiry.

4. If the petitioners were really interested in co-opearting with the enquiry they would have appeared before the respondent police when they were summoned. Since they failed to participate in the enquiry their assurance before this Court cannot be taken for consideration.

5. Hence the petition stands dismissed.
