ORDER

(Order of the Court was made by N.SATHISH KUMAR, J.) The petitioner seeks for a writ of mandamus restraining the respondents from permitting or opening a TASMAC (Elite Bar) at Plot Nos.17 and 8, Ward No.1, Block No.81, TS Nos. 2967/1 and 2963/1 within Thanjavur Municipal Corporation limits. 2.It is the grievance of the petitioner that the respondents are trying to open the TASMAC elite bar in close proximity to the Educational Institution, place of worship as well as residential area. 3.Whereas, the learned counsel for the respondent would submit that the proposed TASMAC is situated nearly one kilometer away from the restricted area.

4.Merely on the basis of the allegation of the petitioner that the proposed TASMAC is within the vicinity of restricted area, we are of the view that a positive direction as sought for by the petitioner cannot be 2/4

granted. It is for the competent authorities to take into consideration the proximity of the educational institution and other relevant aspects, and thereafter take an appropriate decision in accordance with law. 5.With the above observation, this writ petition is disposed of. No costs.
