For Respondent : Mr.A.P.G.Ohm Chairma Prabhu, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 32 of 2020 on the respondent police ORDER : The Court made the following order :- The petitioner herein seeks anticipatory bail since he apprehends arrest in Crime No.32 of 2020 for the offences under Sections 5(l) r/w.6 of POCSO Act, 201 and 506(ii) of IPC.

2. The gist of the complaint against this petitioner is that he along with one Dinesh has taken photos of the victim girl while she was in compromise position and threatening her. The specific allegation against Dinesh is that he has made an aggravated penetrative sex and this petitioner is accomplice. The 164 Cr.P.C statement of the victim girl indicates that the victim girl was in love with one Dinesh. Taking advantage of that the said Dinesh has https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.5546 of 2020 taken some photos of the victim girl and thereafter threatened the defacto complainant. This petitioner being the friend of said Dinesh is also black mailing her for sexual favour. The specific allegation against this petitioner been stated in the 164 Cr.P.C statement of the victim girl.

3. The learned Government Advocate(Crl.Side) would submit that unless the petitioner is secured incriminating photos of the victim girl cannot be retrieved.

4. Considering the nature of offence and its gravity, this Court is not inclined to grant anticipatory bail to the petitioner.

5. Hence the petition stands dismissed.
