Respondents PRAYER: Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondents to issue assignment patta to the petitioner in Survey No.101/1, Thennur 1st Bit Village, Madurai North Taluk, Madurai District, by considering his representation, dated 12.01.2022, within the period that may be stipulated by this Court.

ORDER

This writ petition has been filed for a Mandamus seeking for a direction to the respondents to issue assignment patta to the petitioner in respect of the property situated in Survey No.101/1, Thennur 1st Bit Village, Madurai North Taluk, Madurai District, by considering his representation, dated 12.01.2022, within a time frame to be fixed by this Court.

2.According to the petitioner, he is in possession of the aforementioned property, which is a Government land. According to him, he is entitled for issuance of patta as per Section 15 of the Revenue Standing Order. In such circumstances, he has given a representation on 12.01.2022. Since the representation has not been considered till date, he has filed this writ petition. 3.Heard Mr.M.Jerin Mathew, the learned counsel appearing for the petitioner and Mr.D.Sasikumar, learned Additional Government Pleader, who accepts notice on behalf of the respondents. https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD)No.6156 of 2022 4.No prejudice would be caused to the respondents, if the petitioner's representation is considered on merits and in accordance with law, after affording a fair hearing to the petitioner, within a time frame to be fixed by this Court. It is for the respondents to consider whether the petitioner will be entitled for patta or not as per Section 15 of the Revenue Standing Order.

5.For the foregoing reasons, this Court directs the second respondent to consider the petitioner's representation, dated 12.01.2022, seeking for issuance of an assignment patta in his name in respect of the property situated in S.No.101/1, Thennur 1st Bit Village, Madurai North Taluk, Madurai District and pass final orders on merits and in accordance with law, after affording a fair hearing to the petitioner including granting him the right of personal hearing, within a period of four months from the date of receipt of a copy of this order.

6.With the aforesaid directions, this writ petition is disposed of. No costs.
