PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus or any other writ or direction directing the 1st respondent to consider the representation of the petitioner dated 09.01.2026 and to pass appropriate orders for cancellation of existing HP agreement between the Cholamandalam Investment and Finance Company Ltd and the 6th respondent in the Registration Certificate of the vehicle bearing Registration No. TN 32 BF 2686 and also transfer of ownership from its registered owner, the 6th respondent to the petitioner by surrendering the permit or any other relief as this Honble Court may deem fit and proper in the circumstances of this case and thus render justice.

ORDER

The writ petition is filed for a direction to the 1st respondent to consider the representation of the petitioner dated 09.01.2026 and to pass appropriate orders for cancellation of existing hire purchase agreement between the Cholamandalam Investment and Finance Company Limited and the 6th respondent and also to effect the name transfer in respect of the vehicle bearing registration number TN 32 BF 2686. 2/6

2. Mr.M.Lingadurai, learned Special Government Pleader takes notice on behalf of the 1st respondent.

3. By consent of both the parties, the writ petition is taken up for final disposal at the admission stage itself. Since no adverse orders are to be passed against R2 to R6, orders are being passed without issuing notice to them.

4. Heard the learned counsel on either side and perused the materials available on record.

5. The grievance of the petitioner is that the vehicle mentioned above bearing registration no.TN 32 BF 2686 was financed by the 5th respondent namely Cholamandalam Investment and Finance Company Ltd., under a hire purchase agreement with the 6th respondent namely Mr.G.Gokula Krishnan. It appears that the 6th respondent has defaulted on payment and therefore, the 5th respondent through the 2nd respondent, auctioneer, brought the vehicle to a public auction and the petitioner was the successful bidder/auction purchaser and the vehicle was also 3/6

entrusted to the petitioner. Thought, the petitioner has made appropriate application along with necessary documents and payment to the 1st respondent, the same has not been considered till date. Therefore, the petitioner is before this Court.

When the matter came up for hearing today, the learned Special Government Pleader appearing for the 1st respondent would submit that an enquiry as per Section 51(4) and (5) of the Motor Vehicles Act, 1988 have to be conducted by the 1st respondent and upon being satisfied about the auction of the property and the other conditions being complied, the necessary change of name will be carried out and also the the cancellation of the hire purchase endorsement will also be made.

In view thereof, without expressing any opinion on the merits of the matter, the 1st respondent is directed to conduct an enquiry based on the representation of the petitioner dated 09.01.2026 and thereafter, pass appropriate orders on its own merits and in accordance with law, within a period of eight (8) weeks from the date of receipt of a web copy of this order, after issuing notice to the petitioner and respondents 2 to 6. 4/6

8. The writ petition stands disposed of with the above observations. No costs.
