THE HONOURABLE MR.JUSTICE M.S.RAMESH W.P.(MD) No.10444 of 2018 and W.M.P.(MD) No.9541 of 2018 G.Suresh ... Petitioner Vs.
1. The Chairman and Managing Director, Tamilnadu Electricity Generation and Distribution Corporation, 144, Anna Salai, Chennai.
2. The Superintending Engineer, Tamilnadu Electricity Generation and Distribution Corporation, Karur.
3. S.Ravi ... Respondents PRAYER: Writ petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, fore bearing first and second respondents from disbursing the earn leave salary and medical leave salary to the third respondent till the disposal of the O.S.No.108/2014 on the file of the 2nd Additional District Judge, Tiruchirappalli.
For Petitioner :
Mr.V.Muthusamundeeswaran For R-1 & R-2 :
Mr.E.P.Venketeshwar for S.M.S.Johnny Basha
O R D E R
The prayer in the writ petition cannot be maintainable in view of the fact that in connection with the recovery of loan, civil suit in O.S.No.108 of 2014 has already been instituted by the petitioner herein and the same is pending before the learned Additional District Judge, Tiruchirappalli. While that being so, it would not appropriate to this Court to refrain the electricity Board from disbursing the terminal benefits of the third respondent herein. If at all the petitioner is aggrieved, it is open to him to redress his grievance before the civil proceedings.
