ORDER

The Transfer Civil Miscellaneous Petition is filed to withdraw and transfer HMOP No.2874 of 2013 from the Family Court at Madras to Subordinate Court at Nagercoil.

2.The petitioner herein is the husband and the respondent is the wife. The petitioner has filed this petition stating that the Family Court, Chennai is not having jurisdiction to try the HMOP. 3.The learned counsel for the respondent represented that already in the HMOP, the petitioner was set ex-parte and ex-parte evidence was recorded and posted for orders.

4.In the above circumstances, I am not inclined the Transfer the H.M.O.P.No.2874 of 2013 from the file of the Family Court, Madras to Subordinate Court, Nagercoil. Hence, this petition is dismissed. No costs. Consequently, connected Miscellaneous Petition is closed. am Sd/-.
