Prayer : Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to issue a direction, directing the 2nd respondent herein not to harass the petitioner under the guise of the enquiry in the interest of justice.

ORDER

This petition is filed seeking a direction to the 2nd respondent herein not to harass the petitioner under the guise of the enquiry in the interest of justice.

2.When the matter is taken up for hearing, the learned Additional Public Prosecutor would submit that based upon the complaint given by the third respondent herein, enquiry was undertaken. During the course of enquiry, it was found that the it is civil dispute and both the parties are appeared before the enquiry officer and they were given a statement that they will resolve their issue through the Revenue Authorities or through the Civil Court. Based upon the undertaking, it was closed on 15.03.2023.

3.Since the enquiry has been closed, nothing survives for further consideration or direction in this petition. This Petition has became infructuous and accordingly this Criminal Original Petition is dismissed as infructuous.
