THE HONOURABLE MR.JUSTICE G.R.SWAMINATHAN Crl.O.P(MD)No.5572 of 2020 S.Jeyalatchumi ... Petitioner Vs 1.The Commissioner of Police, Madurai City.

2.The Inspector of Police, Thirupparankundram Police Station, Thirupparankundram, Madurai.

3.Maha ... Respondents PRAYER: Petition filed under Section 482 Code of Criminal Procedure, to direct the second respondent herein not to harass the petitioner in name of enquiry and without due process of law. For Petitioner : Mr.P.Venkatesan For R1 & R2 : Mr.A.Robinson Government Advocate (Crl.side)

ORDER

Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.side) appearing for R1 and R2. 2.The petitioner's counsel alleges that she is being harassed at the instance of the third respondent.

3.According to the petitioner's counsel, the third respondent herein had already lodged a complaint before some other police station in the year 2019 itself. The petitioner would further allege that the second respondent is compelling the petitioner to arrange marriage between her son and the third respondent herein. 4.The learned Government Advocate (Crl.side), while denying the said allegation, would state that the complaint has been received from the third respondent and that, she wants the issue to be amicably resolved.

5. I am of the view that interest of justice will be served by issuing the following directions:- (I) The second respondent will issue summons in writing, if he wants to enquire the petitioner. There cannot be any oral summon for attending enquiry.

(II) If the second respondent registers any FIR, the petitioner will be given due notice, so that, the petitioner will have breathing time to move the concerned Court for the relief of anticipatory bail.
