ORDER

2. The learned Additional Public Prosecutor appearing for the respondent police vehemently objected to the consideration of the anticipatory bail application, on the ground that the co-accused has already been convicted. The petitioner, who is A-2, was also in possession at the time of the occurrence and was arrayed as an accused on the basis of such possession. Therefore, at this stage, the petition seeking anticipatory bail cannot be considered.
3. Hence, the petitioner is directed to surrender before the concerned I Additional District Court for NDPS Act Cases, Madurai, and file a bail application. Upon such filing, the Trial Court is directed to consider the same on the very same day, and while doing so, the Trial Court shall take into account the facts and circumstances of the case.
4. With these observation, this Criminal Original Petition is disposed of.
