Respondent Prayer: The Criminal Original Petition is filed under Section 439 (1)(b) of Cr.P.C., to call for the records in Cr.M.P.No.451 of 2017, dated 22.02.2017 on the file of the Learned Principal Sessions Judge, Tiruchirappalli, Tiruchirappalli District and set aside the condition directing the petitioner herein to deposit a sum of Rs.2,84,000/- to the credit of Cr.No.1006 of 2016 on the file of the respondent.

O R D E R

This Criminal Original Petition is filed for relaxation of the condition imposed by the Principal Sessions Judge, Tiruchirappalli in Cr.M.P.No.451 of 2017, dated 22.02.2017.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.side) appearing for the respondent.

3.The learned counsel for the petitioner submits that though the Sessions Court kind enough to grant bail on deposit of sum of Rs.2,84,000/-, due to his inability to mobilize the fund, he could not avail the bail. Therefore, he has sought for the intervention of the Court to modify the condition. The petitioner has filed affidavit saying that he undertakes to deposit a sum of Rs.50,000/- to the credit of Cr.No.1006 of 2016 instead of Rs.2,84,000/- as ordered by the Sessions Court. https://hcservices.ecourts.gov.in/hcservices/

4.The father of the petitioner has also filed a supporting affidavit, undertaking to ensure the deposit of Rs.50,000/-. 5.Taking note of the above facts, the bail condition is modified to the effect that it is suffice for the petitioner to deposit a sum of Rs.50,000/- instead of Rs.2,84,000/- as ordered by the Sessions Court and all other conditions remains intact. 6.With the above modification, this petition is ordered.
