ORDER

Seeking to grant permission and adequate police protection to conduct Kabaddi tournament scheduled to be held on 21.05.2026, morning 06.00 a.m to 24.05.2026 upto 12.00 p.m at Neethi Nager, Melur Main Road, Y.Othakkadai, Madurai District considering the petitioner's representation, dated 20.12.2025, this writ petition is filed.

The learned Additional Public Prosecutor submitted that they are seeking permission to conduct Kabaddi Tournament for a period of four days in a place which is very near to Madurai Bench of Madras High Court of Madras. Hence, the destination where the Kabaddi Tournament is proposed to be conducted needs reconsideration.

3. However, the learned counsel for the petitioner submitted that 2/6

even earlier, with the permission of this Court, Kabaddi tournament was conducted in the same ground and drew my attention to the order passed by this court in W.P(MD)No.7810 of 2024, dated 23.04.2024 where this Court had given permission to conduct Kabaddi competition in the same destination.

4. Heard the learned counsel on either side and carefully perused the materials available on record.

It is needless to point out that whenever a representation of this nature is made to a Statutory Authority, there is a duty cast upon the respondent to consider the same on its own merits and pass appropriate orders in one way or other instead of keeping the same pending indefinitely. As such, non-consideration of the representation made by the Statutory Authority would amount to dereliction of duty and hence, this Court will be justified in invoking the extraordinary powers under Article 226 of the Constitution of India.

6. In view of the submissions made on either side, the respondents 3/6

are directed to consider the petitioner's representation, dated 20.12.2025 and pass appropriate orders, on merits and in accordance with law, within a period of three (3) weeks from the date of receipt of copy of this order.

7. With the above directions, this Writ Petition stands disposed of. No costs.
