PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus calling for the records relating to the impugned online Memorandum in File No. 2024/0103/15/405435, dated 08.06.2024 read with File No. 2024/0103/15/405392 dated 08.06.2024 on the file of the 3rd respondent quash the same as illegal and consequently direct the 3rd respondent to mutate the patta with respect to petition mentioned survey numbers in the name of the petitioner within a time frame fixed by this Court. The petitioner challenges the impugned online Memorandum in File No. 2024/0103/15/405435, dated 08.06.2024 read with File No. 2024/0103/15/405392 dated 08.06.2024 on the file of the third respondent.

2.Heard the learned Counsel for the petitioner and Mr.M.Lingadurai, learned Special Government Pleader for the respondents.
3.On going through the impugned order, I find that the only reason which has been given is that the patta has been issued subject to conditions. Therefore, the impugned order is clearly non-speaking and also without affording an opportunity to the writ petitioner, who sought for issuance of patta based on his registered sale deed. 4.For this limited reason, I am inclined to set aside the impugned order and remit the matter to the third respondent for hearing the petitioner and also conducting an enquiry with regard to the patta application of the writ petitioner and thereafter pass orders on merits and in accordance with law, within a period of twelve weeks, from the date of receipt of a copy of this order.
5.It is made clear that if the reason reflecting in the online note that 3/5
the patta has been issued subject to conditions, then the Tahsildar shall furnish a copy of the conditions to the petitioner to enable the petitioner to make his objections.
6.With the above direction, this writ petition is disposed of. No costs. Consequently, the connected miscellaneous petition is closed. 12.03.2025 Internet :Yes Index :Yes/No NCC :Yes/No LR To
