Respondents PRAYER: Petition is are filed under Article 226 of the Constitution of India, to issue a writ of Mandamus, directing the respondents 1 to 4 to strictly monitor the de-silting works in Kolunjikootam water tank and Moongil water tank situates in Survey Nos.183 & 199, Kuthakottai village, Keelakarai Taluk, Ramanathapuram District as stipulated by the order of the 1st respondent dated 31.10.2018 in Na.Ka.G&M.1/225/2018 and consequently direct the respondents 1 to 4 to take appropriate action against the persons those who are violating the order of the 1st respondent dated 31.10.2018 in Na.Ka.G&M.1/225/2018.

[Order of the Court was made by N.KIRUBAKARAN, J.] This writ petition has been filed seeking direction to the respondents 1 to 4 to strictly monitor the de-silting works done by the 5th respondent in Kolunjikootam water tank and Moongil water tank situates in Survey Nos.183 & 199, Kuthakottai village, Keelakarai Taluk, Ramanathapuram District.
2.Heard the learned counsel appearing for the petitioner and the learned Special Government Pleader appearing for the respondents 1 to 5 and also the learned counsel appearing for the 5th respondent. 3.When the matter is called today, the learned counsel appearing for the petitioner would submit that the de-silting work has been entrusted to the 5th respondent by way of action and in the guise of de-silting the above tank, the 5th respondent is taking away sand, gravel and soil more than the permitted quantity and hence, the petitioner has given a representation dated 16.11.2018 to the respondents to monitor the de-silting work doing by the 5th respondent. Since no action has been taken, the petitioner has approached this Court for the relief stated earlier. 4.The learned Special Government Pleader appearing for the respondents 1 to 4 and also the learned counsel appearing for the 5th respondent would submit that already 50% of the work has been completed.
5.Since 50% of the de-silting work has been completed, the respondents 1 to 4 are directed to monitor the balance work of desilting to be done by the 5th respondent. 6.With the above direction, this writ petition is disposed of.
