Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the Respondents 1 to 4 to initiate an

appropriate action to conduct the Survey as per section 9 and 10 of Tamil Nadu Survey and Boundaries Act 1923 in respect of petitioner landed properties in Survey numbers 1264/2A, 1264/4A, 1264/4C, 1264/4E, 1264/6B, 1264/7A, 1270/1A2, 1270/1C5, 1276, 1277/1A1, 1277/1A2, 1277/1B, C.,D,E, 1277/2A, 1277/2C4, 1277/3A, 1277/4A, 1277/5A1, 1277/6A2, 1277/6C5, 1277/7A and 1277/7C1 as morefully mentioned in her survey challan situated at Nallamanarkottai Village, Vendasandur Taluk, Dindigul District by considering the representation dated 04.09.2025 to the respondents 1 to 4 and thereupon to lay the boundary stone in an appropriate places at the petitioner cost through the Survey Department with the aid of 5th respondent.

ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the respondents 1 to 4 to initiate an appropriate action to conduct the Survey as per section 9 and 10 of Tamil Nadu Survey and Boundaries Act 1923 by considering the representation dated 04.09.2025 and thereupon to lay the boundary stone in an appropriate places at the petitioner's cost through the Survey Department with the aid of 5th respondent.

2.The petitioner has purchased the property through 4 sale deeds, dated 23.10.2017, 07/11/2017. 31/12/2020 and 08/06/2022. However, the petitioner's brothers and sisters created problem and has damaged some of the properties. Hence, the petitioner preferred a complaint to be concerned police officer in CSR.No.658 of 2025, dated 28.11.2025. The said CSR was closed wherein it is agreed that the petitioner's brothers and sisters would not create any problem. Now, the petitioner is seeking to

survey the land.

3.When the petitioner has purchased the land, the petitioner is entitled to the property. Consequently, the petitioner is entitled to survey his own land. Therefore, the 3rd respondent Tahsildar with the assistance of the 4th respondent Surveyor shall survey the property. The said survey shall be conducted in the presence of the petitioner. If the Tahsildar is seeking any police protection, the 5th respondent shall provide police protection. The official respondents shall adhere to the following Standard Operating Procedures:

• The official respondents shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving the notice of survey.

• After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction.

• If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest.

The aforesaid procedure shall be strictly followed by the parties. The said exercise shall be completed within a period of twelve weeks from the date of receipt of a copy

of this order.

4.With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
