ORDER

The present petition has been filed for issuance of Writ of Mandamus directing the second respondent to take appropriate action on the petitioner's complaint, dated 04.03.2025 and conclude the same within a time frame fixed by this Court.

2. According to the petitioner, she lodged a complaint against the third respondent for the offences of criminal breach of trust and cheating. But the said complaint has not been considered by the respondents. Therefore, the petitioner sent a representation on 04.03.2025 but the same has not been considered. Hence, the petitioner filed this petition.

The learned Additional Public Prosecutor appearing for the official respondents would submit that there is a matrimonial dispute pending between the petitioner and the third respondent and thereby, the petitioner lodged a complaint on 04.03.2025 and the same is under enquiry and they will conduct enquiry and dispose of the same within a week.

4. Since the prayer of the petitioner is to take action based on the petitioner's complaint, dated 04.03.2025 and the second respondent also admitted the receipt of complaint and the same is under enquiry, this Court even without issuing notice to the third respondent inclined to pass orders.

5. Since the complaint of the petitioner is under consideration by the second respondent, it is for the second respondent to complete the enquiry within a week in accordance with law. In view of the same, this Court directs the second respondent to complete the enquiry, within a period of one (1) week from the date of this order in accordance with law.

6. With the above said observations and directions, this writ petition stands disposed of. There shall be no order as to costs. 12.03.2025 NCC : Yes / No Index : Yes / No Internet : Yes BTR 3/5
