ORDER
(Order of the Court was made by N.SATHISH KUMAR, J.) The present writ petition has been filed for the following relief: "To forbear the respondents from constructing the Public Distribution System building within the premises of the Government Middle School in Kallur Village, Kumbakonam Taluk, Thanjavur District and consequently, direct the respondents to relocate the said building to any suitable Government land."

It is the case of the petitioner that the respondents are attempting to construct a public distribution system building within the premises of Government Middle School in Kallur Village, Kumbakonam Taluk, Thanjavur. According to him, earlier it was proposed to construct it opposite to the village community hall. However, a suit has been filed by a third party in O.S.No.6 of 2024 on the file of the Additional District Munsif Court, Kumbakonam. Now, the authorities shifted the construction of building within the school premises. If the building is 2/5
constructed within the school premises, the same will cause disturbances to the school.

The learned Government Advocate for the respondents 1 and 2, on instructions, submits that the said school has been situated in a large extent of Government poramboke land and already VAO office and Anganvadi buildings were also constructed during the petitioner's tenure when the petitioner was a President of the village. Now, due to some motive, the present writ petition has been filed.
4. Heard both sides and perused the records.
5. It is not disputed that the Anganvadi and VAO office are situated in the said Government poramboke land, where the school is situated in a larger extent. Since VAO office and Anganvadi are already situated and a larger extent of land is available, the fact that only the construction of public distribution system building will cause disturbance to the school is not acceptable. Hence, we see that this writ petition has not been filed with a bona fide intention and no element of public interest litigation is 3/5
involved.
6. With the said observations, this Writ Petition is dismissed. No costs.
