PRAYER :- For Bail in Crime No.139 of 2020 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner was arrested on 17.05.2020 for the alleged offence under Sections 294(b), 353,506(ii) of IPC and 8(c) r/w.20(b) (ii)(B) of NDPS Act and Section 3, 25(1B)(a) of Arms Act.
2. As per the prosecution on 17.05.2020 when the respondent police went in search of the petitioner to secure him for executing Non Bailable Warrant he showed sword and threatened the police party and thereafter he was apprehended. On search they found the accused in possession of 1,200gm of Ganja and a country made gun. The same was recovered under mahazhar..

3. The learned Additional Public Prosecutor opposed granting
CRL OP(MD). No.5625 of 2020 bail on the ground that the petitioner is having bad antecedent. Out of four previous cases against him and in three cases he has jumped bail and Non Bailable Warrant is pending. The learned Additional Public Prosecutor would also submit that investigation is at the nascent stage and release of the petitioner will hamper the investigation.
4. Taking into consideration of the fact that the investigation is at the nascent stage, this Court is not inclined to grant bail to the petitioner.
5. Hence, this bail petition is dismissed.
