ORDER

The writ petitioner has filed this petition seeking to recall the order passed by this Court in W.P.(MD)No.6705 of 2023 dated 04.12.2025.

2. The petitioner, who is working as an Assistant Professor, was engaged as Principal (in-charge) for the second respondent College for some time. According to him, the first respondent, vide proceedings dated 30.01.2023, directed the second respondent College to appoint him as Principal of the College. However, the second respondent College has engaged the 3rd respondent as Principal (in-charge). Therefore, the petitioner filed the above writ petition seeking a writ of mandamus directing the second respondent to appoint him as Principal (in-charge) for the College instead of the 3rd respondent.

3. When the writ petition was taken up for hearing, the learned counsel for the second respondent submitted that the 3rd respondent has been appointed as regular Principal for the second respondent College. 2/5

Considering the submission of the second respondent that the 3rd respondent has been appointed as regular Principal, this Court, by its order dated 04.12.2025, closed the writ petition with liberty to the petitioner to workout his remedy by challenging the order of appointment of the 3rd respondent.

Now, the petitioner has filed this petition seeking to recall the order dated 04.12.2025 that the second respondent has made a false representation before this Court that the 3rd respondent has been appointed as regular Principal for the second respondent College and it is not so and the 3rd respondent has been appointed as Principal (in-charge).

5. This Court considered the rival submissions made.

6. The writ petition filed by the petitioner was closed by this Court on 04.12.2025 only based on the representation made by the learned counsel for the second respondent.

7. Now, the learned counsel for the second respondent has clarified that inadvertently, the mistake has been committed and it is not intentionally made and the 3rd respondent has not been appointed as regular Principal and he has been appointed as Principal (in-charge).

7. Considering the submission made by the learned counsel for the second respondent, the order passed by this Court in W.P.(MD)No.6705 of 2023 dated 04.12.2025 is hereby re-called. The Registry is to list the writ petition before the concerned Court.
