Respondents Prayer: Criminal Original Petition is filed under Section 482 of Cr.P.C, to issue a direction to the respondents to provide adequate police protection to the petitioner to take possession of the property situated in Madurai District, Madurai South Registration and Madurai Joint IV Sub Registration District in Corporation Old Ward No.34, New Ward No.86, Madurai Town Survey Ward No.4 , Kazdmar Street 3rd lane, House bearing Door No.76 B, comprises in T.S.No.1134 measuring East - West, Northern side 40 3⁄4 and southern side 41' south-north western side 34 3⁄4' and eastern side 35' out of the said entire house property northern portion house with total area of site 484 sq.ft., with buildings consist of ground floor 48 sq.ft., and first floor 450 sq.feet, totally 930 sq.feet, as ground floor, first floor buildings on the basis of the representation of the petitioner, dated 19.03.2017 and 21.03.2017.

The case of the petitioner is that he has legally purchased a property that was brought on sale by the State Bank of India under SARFAESI Act and that the third respondent is illegally https://hcservices.ecourts.gov.in/hcservices/

preventing the petitioner from enjoying the property. Therefore, the petitioner has given a complaint dated 16.03.2017 to the Commissioner of Police, Madurai City, seeking police protection and the same has been forwarded to the Inspector of Police, Thideernagar Police Station, Madurai for enquiry.

2. Today, Mr.K.John, Special Sub Inspector, Thideernagar Police Station is present and on instructions, the learned Government Advocate (Crl.side) submitted that the Inspector of Police, Thideernagar Police Station has issued a notice to the petitioner for enquiry on 03.04.2017, but the petitioner has not appeared for the enquiry.

3. Under such circumstances, the petitioner is directed to go to the 2nd respondent Police Station and take part in the enquiry and the second respondent is directed to conduct enquiry by calling both the parties and take action in accordance with law by providing police protection to the petitioner, if there is no other legal impediment.

4. With the above direction, the Criminal Original Petition is disposed of.
