PRAYER :- For Bail in Crime No.556 of 2023 on the file of the Respondent Police. ORDER : The Court made the following order :- The respondent police registered a case as against this petitioner in Crime 1/3
No.556 of 2023 for the offence under Sections 8(c), 20(b)(ii)C, 25 and 29(i) of Narcotic Drugs & Psychotropic Substances Act, 1985 and remanded him into judicial custody on 02.12.2023. Therefore, the petitioner has filed this petition seeking bail.
2. The case of the prosecution is that on 02.12.2023 at about 14.00 hrs., based on the secret information, the respondent Police conducted vehicle check up near Keelaurappanur Shivanammal Kovil in Thirumangalam to Cholavanthan Road. At that time, the respondent Police saw a bike bearing Reg.No.TN58 BH 4719, Yamaha FZX and a Ford Endeavour car bearing Registration No.TN09 BC 5157, behind that bike. On seeing the Police, the accused persons tried to escape from the scene of occurrence, however, the respondent Police apprehended them and also recovered 22 kgs. of ganja from that car. Hence, the case.
3. There is no representation for the petitioner.
4. The learned Additional Public Prosecutor raised serious objections that the contraband of 22 kgs. of ganja was recovered from a Car bearing Registration No.TN09BC 5157. The petitioner is also one of occupants of the Car and he is also involved in another NDPS case in Crime No.229 of 2022.
5. Considering the quantity of ganja involved in this case and also considering the antecedent of the petitioner, this Court is not inclined to grant bail to the petitioner.
