PRAYER : Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the 4th and 5th respondents to consider and dispose the petitioner compliant dated 02.02.2026 and consecutively direct the 5th respondents to take necessary action against the 6th respondent based on their acquittal in CC No.218 of 2013 dated 28.07.2020 on the file of the learned Judicial Magistrate Uthamapalayam in respect of false complaint filed by the 6th respondent against us by considering the petitioner's representation dated 02.02.2026.

ORDER

W.M.P.Crl.(MD)No.327 of 2026 filed seeking to file a single Writ Petition is ordered.

This writ petition has been filed seeking for a direction to the 4th and 5th respondents to consider and dispose the petitioner's compliant dated 02.02.2026 and consecutively direct the 5th respondent to take necessary action against the 6th respondent based on their acquittal in CC No.218 of 2013 dated 28.07.2020 on the file of the learned Judicial Magistrate Uthamapalayam in respect of false complaint filed by the 6th respondent against us by considering the petitioner's representation dated 02.02.2026. 2/6

The learned counsel appearing for the petitioner submitted that, at the instance of the 6th respondent, several matrimonial cases were filed by her against the petitioners before various forums, who are none other than the 6th respondent's in-laws and are not directly connected with the matrimonial discord that occurred between the 6th respondent and her husband. One such case is CC No. 218 of 2013 on the file of the learned Judicial Magistrate, Uthamapalayam, which culminated from the FIR in Crime No. 3 of 2012 on the file of the 5th respondent. However, the petitioners were unnecessarily subjected to the ordeal of trial, and thereafter, the said criminal case ended in acquittal on 28.08.2020.

The learned counsel appearing for the petitioner further submitted that, even after the acquittal, the 6th respondent has not stopped her practice of continuously lodging frivolous complaints before various police stations, thereby unnecessarily subjecting the petitioners to harassment. She had lodged a complaint before the Superintendent of Police, Theni, in the month of January 2026. Hence, left with no other option, the petitioners sent a representation dated 02.02.2026 to the official respondents, which is still pending consideration. Even thereafter, she lodged another complaint before the Deputy Superintendent of Police, Velankanni, from where summons have also been 3/6

received by the petitioners. Hence, this petition has been filed by the petitioners.

The learned Additional Public Prosecutor appearing for the official respondents categorically contended that this writ petition itself is not maintainable, for the reason that the only remedy available to the petitioners is to file a civil suit for damages or initiate appropriate criminal proceedings for claiming damages against the 6th respondent. However, in the present case, the period of limitation for initiating such proceedings has already elapsed. Hence, having been left with no other option, the petitioners are attempting to find a new way to prosecute the 6th respondent by submitting a representation dated 02.02.2026, which cannot be considered and is liable to be rejected.

6. Heard the learned counsel on either side and carefully perused the materials available on record.

It is clear that the petitioners have faced the ordeal of trial before the learned Judicial Magistrate, Uthamapalayam in CC No.218 of 2013 for the offences under Sections 294(b), 498A and 506(i) of IPC and Section 4 of Tamil Nadu Prohibition of Women Harassment Act, and the same ended in acquittal. 4/6

That apart, it is understood from the submission made by the learned counsel appearing for the petitioners that the petitioners are not living together with the 6th respondent. However, it is seen that the 6th respondent had filed two complaints before the Deputy Superintendent of Police, Velankanni and the Superintendent of Police, Theni, for which the petitioners were required to appear on summon. It is the bounden duty of the police to enquire into any complaint lodged against a person in accordance with law. In such view of the matter, though the dispute appears to be matrimonial in nature, no positive direction can be issued in this writ petition. Hence, this writ petition stands dismissed.
