Respondents PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to close the TASMAC Liquor Shops in and around Kumbakonam Town, Thanjavur District on account of Local Holiday declared by the Tamil Nadu Government in G.O.Ms.No.297 dated 10.05.2023 by following the previous year 1st respondent proceedings in Na.Ka. 1135/2023/A6 dated 22.02.2024 declaring to close the TASMAC liquor shops in and around Kumbakonam, with regard to Maasi Maham Perunthiruvizha, which is scheduled to be conducted in the present year i.e., on 12.03.2025, by considering

the petitioners representation dated 28.02.2025, within a stipulated time that may be fixed by this Court.

ORDER

[Order of the Court was made by J.NISHA BANU, J.] By consent of both parties, this Writ Petition is taken up for final disposal at the stage of admission itself.

2.It is the grievance of the petitioner that his representation dated 28.02.2025 to close the TASMAC liquor shops in and around Kumbakonam Town, Thanjavur District on account of Local Holiday for 'Maasi Maham Perunthiruvizha', which is scheduled to be conducted in the present year i.e., on 12.03.2025, declared by the Tamil Nadu Government in G.O.Ms.No.297 dated 10.05.2023 by following the 1st respondent's previous year proceedings in Na.Ka. 1135/2023/A6 dated 22.02.2024, declaring to close the TASMAC liquor shops in and around Kumbakonam, is kept pending till date without any progress. Therefore, he has filed this Writ Petition with the aforesaid prayer.

3.Mr.P.Thilak Kumar, learned Government Pleader, who takes notice on behalf of the 1st respondent, submits that the representation of the petitioner would be considered and appropriate orders would be passed on its own merits within a period that may be stipulated by this Court.

4.Considering the limited scope of the prayer sought for by the petitioner, without expressing any opinion on the merits of the claim made by the petitioner either in the representation or in the affidavit filed in support of this Writ Petition, we direct the 1st respondent to consider the representation of the petitioner dated 28.02.2025 after giving sufficient opportunity of hearing to the petitioner and pass appropriate orders on merits and in accordance with law by today (11.03.2025) itself.
