ORDER
Heard the learned counsel for the writ petitioner and the learned Additional Government Pleader for the respondents 1 to 4. Though the names of the private respondents have been printed in the cause list, they have not chosen to enter appearance. 2.It is seen that the petitioner purchased the petition mentioned land from the sixth respondent. The fifth respondent and the sixth respondent are brothers. After purchase from the sixth respondent, separate patta was issued in favour of the writ petitioner. The said patta was cancelled by the impugned order dated 16.02.2022. The specific stand of the writ petitioner was that he was not put on notice. I went through the impugned order in full. There is no material to show that the petitioner was ever served with any notice before passing the impugned order.
There has been a clear violation of the principles of natural justice. The impugned order is set aside and the writ petition is allowed and the matter is remitted to the file of the second respondent to pass orders afresh in accordance with law after issuing notice to all the stakeholders. No costs. Consequently, connected miscellaneous petition is closed.
