For Respondent : R.Anandharaj, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.Not Known of 2020 on the file of the respondent police ORDER : The Court made the following order :- This petition is filed by the petitioner seeking for anticipatory bail alleging that despite the order passed by this Court on 12.03.2020 directing the petitioner to participate in the enquiry and produce all the documents in his support, on such production, the Investigation Officer shall take appropriate decision, in accordance with law, when the petitioner appeared before the respondent police on 12.05.2020, they demanded a sum of Rs.10,00,000/-(Rupees Ten Lakhs only). Hence, he has given a representation on 15.05.2020 through mail annexing the documents.
2. The learned Additional Public Prosecutor submitted that the petitioner neither appear before the respondent Police on 12.05.2020 nor sent any representation on 15.05.2020 with all the documents for perusal and co-operating the enquiry, as alleged in the petition. CRL OP(MD). No.5570 of 2020 coercive action against the petitioner, but will conduct the enquiry in the manner known to law.
3. Heard the rival submissions.
4. It appears that the petitioner has not sofar produced the documents in his support to substantiate his claim against the defacto complainant. Therefore, the respondent is directed to serve summon on the petitioner to appear and produce documents on the date prescribed. If the petitioner fails to co-operate with the enquiry, the respondent Police shall proceed against the petitioner in accordance with law.
5. With the above observations, this Criminal Original Petition is disposed of.
