PRAYER: Petition is filed under Article 226 of the Constitution of India praying for the issue of a Writ of Mandamus directing the respondents 2 and 3 herein to consider the petitioner's representation dated 27.12.2022 by way of rectify as delete the current entry i.e., Oorsuthi Pathai and give him a separate patta in respect of S.No.133/12 and 133/20 of Keelavaluvu village, For Petitioner : Mr.P.Palani For Respondents : Mr.A.Baskaran

ORDER

(Order of the Court was made by R.SUBRAMANIAN, J) Mr.A.Baskaran, learned Additional Government Pleader takes notice for the respondents. By consent, this writ petition is taken up for final disposal at the admission stage itself.

2.It is the grievance of the petitioner that the land belonging to him has been classified as Pathai (Pathway).

3.The petitioner would claim that the property belongs to his family ancestrally and the other sharers have executed release deed in his favour as early as on 15.03.2001. When the petitioner made preparation to divide the land in question between his children, he was informed by the Village Administrative Officer that the land in question is classified as Pathway. Therefore, he made representation to the authorities for reclassification of the same. The application for reclassification was not considered by the authorities.

4.Considering the plight of the petitioner and reasonableness of the request, there will be a direction to the second respondent/Tahsildar to consider the request of the petitioner and pass orders on the said request within a period of six weeks from the date of receipt of a copy of this order. 5.With the above directions, this Writ Petition is disposed of. No costs.
