Respondent Prayer: This Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents herein to survey, subdivide and issue individuals patta in favour of the writ petitioner in respect of Survey No.96/2, comprised in measuring 0.3.50 hectares and situated at South Thittankulam Village, Kovilpatti Taluk, Tuticorin District, by considering the petitioner's representation application Number 2021/0105/28/108047 dated 18.01.2021 within the time framed that may be fixed by this Court.

ORDER

This Writ Petition has been filed for the issue of a Writ of Mandamus, directing the respondent to consider the application submitted by the petitioner on 18.01.2021, wherein, the petitioner has sought to survey, subdivision and issuance of individual patta in his name.

2. The case of the petitioner is that he purchased the subject property by virtue of a registered sale deed dated 29.08.1985. According to the petitioner, he purchased Plot Nos.10 and 11 measuring a total extent of 3.3 cents. The petitioner was also granted joint patta in Patta No.95.

3. The petitioner made an application before the respondent on 18.01.2021 and requested for the survey of the property and for https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD).No.7641 of 2021 sub division of the same and for issuance of an individual patta in favour of the petitioner. Since the representation was not considered, the present Writ Petition has been filed before this Court seeking for appropriate directions.

4. Heard Mr.Chinraj, learned counsel appearing for the petitioner and Mr.M.Muniasamy, learned Additional Government Pleader, appearing on behalf of the respondents.

5. Taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, there shall be a direction to the respondent to consider the application submitted by the petitioner on 18.01.2021 and deal with the same on its own merits and in accordance with law and take a decision within a period of eight (8) weeks from the date of receipt of a copy of this order.

6. The petitioner is directed to make a fresh representation to the respondent along with all the relevant documents and also a copy of this order.

7. The Writ Petition stands disposed of with the above directions. No costs.
