ORDER

The Transfer Civil Miscellaneous Petition is filed to withdraw the case in H.M.O.P.No.95 of 2014 on the file of the Sub Court, Palani, and transfer it to the file of the Sub Court, Pudukkottai.

2. The petitioner herein is the husband and the respondent is the wife. The marriage between the petitioner and the respondent was solemnized on 30.05.2012 against the wish of the respondent's parents. After the marriage, both were residing in matrimonial home at Pudukkottai. In the month of June, 2014, the respondent's parents took her to their home at Pudukkottai. Subsequently, the respondent filed H.M.O.P.No.95 of 2014 before the Sub Court, Palani, for Annulment. The petitioner is working as a Clerical Staff in a Private Company. It is very difficult for him to attend the Court at Palani, for each and every hearing.

3.The learned counsel for the respondent entered appearance through Advocate and he did not file any counter. The learned counsel for the respondent contended that it will not be difficult for the petitioner to attend the hearing in Sub Court, Palani and prayed for dismissal of Tr.CMP.,or to transfer the HMOP to Sub Court, Trichy. 4.Heard the learned counsel for the petitioner and the respondent.

5. In the circumstances, it will be in the interest of justice and convenience of both the parties, the petition filed by the respondent is transferred to some common place i.e., Sub Court, Trichy. https://hcservices.ecourts.gov.in/hcservices/

6. Accordingly, this Transfer Civil Miscellaneous Petition is ordered and H.M.O.P.No.95 of 2014 on the file of the Sub Court, Palani,

is hereby withdrawn and transferred to the file of the Sub Court, Trichy. The learned Sub Judge, Palani, is directed to send the case bundle in H.M.O.P.No.95 of 2014, to the Court of the Sub Court, Trichy, immediately. The Registry is also directed to send back the papers that are pending before the Registry. No costs. Consequently, M.P(MD)No.1 of 2014 is closed.
