PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 1st respondent to dispose the petitioner's representation dated 18.02.2025 demanding to take suitable action against the respondents No.8 to 11 within a time framed fixed by this Court.

(Order of the Court was made by N.SATHISH KUMAR, J.) This writ petition is filed seeking a direction to the first respondent to dispose of the representation of the petitioner dated 18.02.2025.

2.The contention of the petitioner is that he is working in abroad and he has been falsely implicated in a criminal case by one Vijay for the alleged offence under Section 296(b), 115(2), 118(1), 351(3) of BNS in Crime No.03/2025 at Keelathooval Police Station with an intention to spoil the future of the petitioner. He has given a representation to the Human Rights Commissioner to conduct a detailed enquiry regarding the false implication of the petitioner. Since no action has been taken on the said representation, the petitioner has filed the present writ petition.

4.The learned counsel for the petitioner submitted that the petitioner is regular offender he is already facing five criminal cases. 5.At the outset, the court cannot simply direct the authorities to act on the petitioner's representation. If the petitioner believes that his human rights are violated, the proper course for him to adopt is to file a proper application along with all necessary evidences. The very representation of the petitioner itself makes it very clear that he is facing criminal charges, which shows that only in order to thwart the 3/6

investigation and to bring fear on the Investigation Officer, the petitioner send such representation to the Human Rights Commission. 6.Hence, we are of the view that, this writ petition is nothing but an abuse of process of law. Accordingly, this writ petition stands dismissed. There shall be no order as to costs.
