Respondents (Cause title has been suo motu amended vide order dated 05.04.2022) PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents No.2 to 5 to implead the 1st respondent letter proceedings in Na.Ka.No.27392/12/2021 dated 14.09.2021 on the basis of the petitioner's representation dated 04.09.2021 and 04.12.2021 within a stipulated time as fixed by this Court.

ORDER

The writ petition has been filed for a Mandamus to direct the respondents 2 to 5 to implead the 1st respondent's letter proceedings in Na.Ka.No.27392/12/2021 dated 14.09.2021 on the basis of the petitioner's representations dated 04.09.2021 and 04.12.2021. 2.When the matter is taken up for hearing, the learned Additional Government Pleader for the respondents submits that the Additional Chief Secretary of Transport, Secretariat Office, Secretariat, Chennai - 600 009 has been wrongly impleaded as 1st respondent. It is therefore submitted that his name may be deleted. Considering the same, the name of Additional Chief Secretary of Transport, Secretariat Office, Secretariat, Chennai - 600 009 (the 1st respondent) is directed to be deleted and the respondents 2 to 6 shall be re-numbered as respondents 1 to 5.

Hence, the reference to 1st respondent shall mean the Commissioner of Transport, Office of the Commissioner of Transport Tamilnadu, Ezhilagam, Cheppakkan, 3.The petitioner has brought to the notice of this Court of the proceedings of the 1st respondent/Commissioner of Transport, Chennai, dated 14.09.2021, wherein the 1st respondent has directed the 3rd respondent to investigate the matter within a period of 15 days and to give a report. However, no further steps have been taken by the 3rd respondent so far.

4.Considering the above, I am inclined to dispose of this writ petition at the time of admission by directing the respondents 2 to 5 to implement the order of the 1st respondent/Commissioner of Transport, Chennai, dated 14.09.2021 within a period of 6 weeks from the date of receipt of a copy of this order.

5.The writ petition stands disposed of, in terms of the above observations. No costs.
