ORDER : The Court Made the following order :- The petitioner/accused was arrested on 17.03.2017 for the alleged offence punishable under Section 7 of Prevention of Corruption Act, 1988 in Crime No.1 of 2017 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that this petitioner working as Typist in the District Registrar Office, Virudhunagar demanded bribe for forwarding the complaint of the de-facto complainant. During the trap proceedings, the petitioner was caught red-handed, after receiving the bribe amount of Rs.3,000/- and hence, arrested by the respondent police and remanded to judicial custody.
3. The learned counsel for the petitioner submits that the petitioner, pursuant to his arrest, was suspended by the Department and hence, there is no possibility of tampering the witnesses or evidence. In the light of the above fact, the petitioner may be granted bail.
4. Considering the facts of the case, it is a case of demand and acceptance of illegal gratification by a public servant to discharge his official duty. Hence, on receipt of the complaint, the Officials of Vigilance and Anti-Corruption Wing have laid trap and https://hcservices.ecourts.gov.in/hcservices/
caught the petitioner red-handed, after receipt of the money from the decoy witness. Since the investigation is under way, the release of the petitioner on bail will tamper the investigation. Hence, this petition is dismissed.
