PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the second respondent to grant incentive increments for the petitioner's higher qualification on the basis of the recommendation of fourth respondent dated 27.10.2020, considering his representation dated 01.02.2021 which is pending with the second respondent. For Petitioner : Mrs.L.Victoria Gowri For Respondents : Mr.C.M.Mari Chelliah Prabhu Additional Government Pleader

ORDER

(through video conference) Heard Mrs.L.Victoria Gowri, Learned Counsel appearing for the Petitioner and Mr.C.M.Mari Chelliah Prabhu, Learned Additional Government Pleader, who takes notice for the Respondents, and perused the materials placed on record, apart from the pleadings of the parties.

Though the Writ Petition has been filed seeking for direction to the Second Respondent to grant incentive increments to the Petitioner for acquiring M.A., Degree along with other consequential benefits, Learned Counsel for the Petitioner submits that the Petitioner would be satisfied if his representation dated 01.02.2021 made to the Second Respondent in that regard is disposed within a time frame stipulated by this Court and would confine his claim to that extent. Learned Counsel for the Petitioner has also filed a memo to that effect.

Having regard to the aforesaid submission made, this Court without expressing any view on the correctness or entitlement of the claim made by the Petitioner, requires the Second Respondent to dispassionately consider the claim made by the Petitioner in his representation dated 01.02.2021, after affording an opportunity of personal hearing to him and pass reasoned orders on merits and in accordance with law, communicate the decision taken under written acknowledgment and file report of such compliance before the Registrar (Judicial) of this Court by 30.06.2021. 4.

In fine, the Writ Petition is disposed on the aforesaid terms. No costs.
