ORDER : The Court Made the following order :- Petitioner prays for grant of anticipatory bail under Section 438 of Cr.P.C for offences punishable under Sections 406, 420, 294 (b), 506(i) and 120(B) IPC in Crime No.26 of 2014 on the file of the respondent police.
2. Learned counsel for petitioner submitted that petitioner having obtained favourable orders in Crl.O.P.(MD) No.18475 of 2014 dated 17.04.2015 has filed the present petition informing that owing to kidney problem he was unable to go and surrender before the concerned Magistrate as directed and further the order of this Court had informed that the anticipatory bail would be cancelled if the petitioner did not execute the bonds before the concerned Magistrate within 15 days.
3.Heard learned Government Advocate (Crl. Side) on the said https://hcservices.ecourts.gov.in/hcservices/ submissions.
4. On consideration of the facts and circumstances of the case and the submissions made, this Court is of the view that the petitioner can be granted the relief prayed for and accordingly; (a) In the event of arrest by or on appearance before the respondent police;
(b) In the event of appearance before the learned Judicial Magistrate No.II, Virudhunagar within 15 days from the date of receipt of copy of the order, (i) Petitioner shall be enlarged on bail on his executing a bond in a sum of Rs.10,000/-(Rupees Ten Thousand Only) with two sureties for the like sum to their satisfaction; (ii)Petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the fact of the case so as to dissuade him from disclosing such facts to the Court or to any Police Officer;
(iii)Petitioner shall be available for interrogation by the respondent police daily at 10.30 a.m for two weeks and thereafter as and when required.
