PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, 2023, to call for the records from the 2nd respondent police in FIR in Crime No. 14/2026 dated 11.01.2026 and quash the same as devoid of merits against the petitioner.

ORDER

The present petition has been filed by the sole accused in crime No.14 of 2026 on the file of the second respondent police seeking to quash the F.I.R. wherein the petitioner is alleged to have committed the offences under Sections 126(2), 351(2) of BNS, 2023 r/w Section 3(1)(r) of the SC/ST, Prevention of Atrocities Act, 1989.

2. The learned Government Advocate(crl.side) appearing for the respondents 1 and 2, brought to the notice of the Court that the investigation has been closed as mistake of fact and the final report has been filed before the P.C.R. Court, Madurai, on 25.02.2026. He further submits that RC notice has been served upon the defacto complainant in R.C.No.4 of 2026 on 25.02.2026 itself.

3. In view of the fact that F.I.R. has been closed as mistake of fact, no further orders are called for in the present petition. Accordingly, this Criminal Original Petition stands closed. Consequently, connected miscellaneous petition is also closed.
