ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 120(b), 406 and 420 IPC in Crime No. 5 of 2016 on the file of the respondent police, seeks anticipatory bail.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the State.

3. The case of the prosecution is that the petitioner along with other accused promised the defacto complainant to get Medical Seat for his son on payment of Rs.14,00,000/-. On believing the same, the defacto complainant paid the said amount, but the accused persons neither arranged Medical Seat nor paid the received amount.

4. The learned counsel for the petitioner submitted that the petitioner has not committed any offence as alleged by the defacto complainant and he was falsely implicated in this case.

5. Considering the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner with the following condition. Accordingly, the petitioner shall deposit a sum of Rs.2,00,000/- (Rupees Two lakhs only) to the credit of Crime No.5 of 2016 before the learned Judicial Magistrate, Pudukkottai, and on receipt of the same, the petitioner is entitled to be released on bail in the event of arrest or on his appearance before the learned https://hcservices.ecourts.gov.in/hcservices/

Judicial Magistrate, Pudukkottai, within a period of 15 days from the date on which the order copy made ready, and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum each to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 10:30 a.m. until further orders.
