PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to transfer the complaint dt.6.1.2022 and on 27.2.2022 on the file of the 2nd Respondent and direct the 1st Respondent to appoint a Special Officer to enquire the Complaints stated above and if needed order for CBCID enquiry and order for re-enquiry of the complaint given by the petitioner.

ORDER

This petition has been filed seeking direction to transfer the complaint dated 6.1.2022 and on 27.2.2022 on the file of the second respondent and direct the first respondent to appoint a Special Officer to enquire the Complaints stated above and if needed order for CBCID enquiry and order for re-enquiry of the complaint given by the petitioner.

2. The petitioner has lodged complaints on 06.01.2022 and 27.02.2022 and the same is pending on the file of the second respondent. Therefore the petitioner has filed this petition seeking transfer of complaint from the file of the second respondent to the file of the fourth respondent.

3. The learned Additional Public Prosecutor would submit that on receipt of complaint from the petitioner, the second respondent conducted enquiry and the same was closed on 04.03.2022 itself, therefore no compliant is pending on the file of the second respondent as of now.

4. Even before registration of any First Information Report, transfer of complaint does not arise.

5. In view of the same, the Criminal Original Petition stands dismissed. Consequently connected miscellaneous petition is also closed.
