PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, 2023, to call for the records pertaining to the Impugned Final Report in C.C.No. 297 of 2025, on the file of the learned Judicial Magistrate Court, Paramakudi, and quash the same as illegal so far as the petitioner is concerned. ORDER

The present petition has been filed by the third accused in C.C.No.297 of 2025, on the file of the learned Judicial Magistrate, Paramakudi, seeking to quash the charge sheet.

2. A perusal of the charge sheet reveals that the petitioner has been charged with the offences under Sections 294(b), 323, 336, 506(ii) of IPC and Section 4 of TNPHW Act.

3. According to the learned Counsel appearing for the petitioner, his name was not implicated in the FIR, but he has been implicated in the charge sheet and arrayed as the third accused. According to him, due to motive, the petitioner has been wrongly implicated and he has nothing to do with the offences alleged as against him.

4. A perusal of the charge sheet further reveals that the petitioner and others said to have attacked the defacto complaint and prima facie some materials have been placed on record to establish the allegations as against the petitioner.

5. In such view of the matter, this Court is of the considered opinion that no legal grounds have been raised to quash the charge sheet as against the petitioner. It is for the trial Court to dispose of the criminal case on its merits without being influenced by anyone of the observations of this Court.

6. The trial Court is directed to dispose of the case on or before 31.08.2026.

7. With the above said observations, this Criminal Original Petition stands disposed of. Consequently, connected miscellaneous petitions are also closed.
