ORDER : The Court made the following order :- The petitioner/Accused No.1, who apprehends arrest at the hands of the respondent police in Crime No.238 of 2025 for the offence punishable under Section 318 (4) of BNS 2023, seeks anticipatory bail.

The case of the prosecution is that on 25.11.2025 at about 19.00 hours, based on the complaint lodged by the de-facto complainant that the petitioner agreed to sell a tractor bearing Registration No.TN-47-BT-1959 for Rs.5,50,000/- and received a sum of Rs.4,50,000/- as advance. It is alleged that the petitioner failed to transfer RC book thereby cheated the defacto complainant. Hence the case.

3. The learned counsel appearing for the petitioner submits that there is no record to show that the receipt of the amount and there is no agreement entered between them. Hence, he seeks to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) appearing for the respondent submitted that the petitioner had cheated the defacto 2/5

complainant for a sum of Rs.4,50,000/- and the said tractor has not been given to the defacto complainant. He further specifically argued that the petitioner custodial interrogation is very much required. However, he opposed to grant anticipatory bail to the petitioner.

5. This Court has considered the submissions made on either side.

Taking into account of the submission of the learned Government Advocate (Criminal Side), the petitioner intentionally cheated the defacto complainant and upon receiving a sum of Rs.4,50,000/- the tractor has not been given to the defacto complainant, this Court is not inclined to grant anticipatory bail to the petitioner.
