ORDER

This Petition has been filed to relax the condition imposed in the order passed by this Court in Crl.O.P(MD). No.19610 of 2024, dated 06.12.2024.

2. Mr.M.Maran, learned counsel appearing for the petitioner, submitted that the petitioner has been complying with the condition regularly and he prayed for relaxation of the said condition.

3. Mr.S.S.Manoj, learned Government Advocate (Crl. Side) appearing for the 1/3

respondent- Police submits that though the petitioner has been complying with the condition regularly without any violation, in view of the offence involved in this case under the NDPS Act, he prays for a modification of the condition imposed by this Court.

4. In view of the said submission made by the learned Government Advocate (Crl. Side), this Court is inclined to relax the condition imposed on the petitioner in the said Criminal Original Petition.

5. Accordingly, this petition is allowed and condition No.32(b)) imposed by this Court in Crl.O.P(MD). No.19610 of 2024, dated 06.12.2024, is hereby fully relaxed. The petitioner shall appear before the trial Court on all hearing dates without fail. The other conditions shall hold good.

6. It is made clear that if the petitioner files a petition under Section 355 of BNSS, 2023, before the trial Court, the trial Court shall consider the same on its own merits and in accordance with law.
