O R D E R

This Contempt Petition is filed to punish the respondent for committing contempt and willful disobedience of the order passed by this Court on 08.01.2025.

2. When the matter was taken up for hearing on 08.01.2025, undertaking affidavit was filed by both sides stating that they will not interfere with the affairs of the other side. On the basis of the above said undertaking, the order was passed on 08.01.2025. Later stating that there is willful disobedience of the undertaking made before this Court, the present Contempt Petition is filed.

3. Both the parties were present before this Court and learned counsel for the petitioner and the respondents would submit that they are ready for a compromise to be reached before this Court in the form of undertaking. Now the issue is with regard to the installation of stove for performing Annathanam. Now a sketch is prepared by the petitioner himself and produced before this Court for passing orders on the basis of 2/5

the undertaking and understanding. As per the above said sketch, Northern vacant site measuring about 20 feet North - South and 15 feet East - West is allotted to the respondents 1 and 2 herein for installing stove for performing the above said preparation of Annathanam and Neivedhyam pooja to the deity. So far as the petitioner is concerned they are using the Eastern side. This Eastern portion is indicated as md;djhdk; jahh; bra;a cl;gl;l ,lk;/ For this area the respondent has no objection. Similarly, the petitioner also has no objection in complying the undertaking reached between the parties before this Court. Annexed copy of the Sketch filed by the petitioner shall form part of the order.

4. It is submitted by the petitioner that over the dispute totally 5 cases have been registered against the petitioner group and 2 cases have been registered against the respondent 1 and 2, by the police.

5. In view of the compromise and agreement reached between the parties before this Court today, they can approach the concerned investigation officer for closing the case. The Investigation Officer may 3/5

act upon their undertaking, subject to the gravity of offences and subject to the legal opinion.

6. Accordingly, this Contempt Petition is closed. Let the sketch shall form part of the order. No costs.
